I never knew the word “Probate” existed before my grandmother passed away. A few years ago m wonderful grandmother passed away. This was a very sad day for our family. Fortunately, she had most of legal matters cleared up. Years before she had meet with an estate planning attorney to get all of her ducks in a row before her final day. However, the attorney that put all these documents together wasn’t as detail oriented as we had hoped. Its seems that he missed a couple key things to make the will completely legally binding. Also on top of that, the person my grandmother appointed as the executor of her will had passed away prior to my grandmother.
If you have never had to deal with the Probate Courts, consider yourself lucky. Like any legal matter, sometimes it is worth it to high an attorney. This was one of the cases.
Since my grandmother’s friend had passed, I ended up being chosen to take care of the will of my grandmother. I did a little reading on the internet prior to heading down to the Denver Probate Court to get the process moving along.
I present my paperwork to the court clerk who then gave it a quick once over. She asked, “ Are you Ruth?” I joked, “Do I look like a Ruth?”, wrong thing to say. I guess court clerks are like the boarder portal, no sense of humor. Anyways, she processed to tell me she can only work with my grand mother’s friend or a attorney of the family. I tried to explain how Ruth had passed and the family had chosen me to take care of this. This got me as far as car that doesn’t have any gas.
Leaving the court in disappointment, I called my brother and told him the story. He said lets just get a lawyer and be done with it. While, I’m not a fan of lawyers, I didn’t have the time to earn a law degree so I reluctantly agreed.
When I got home I did a search for Probate Attorney, my skin crawled as I typed that into search bar. I start on the phones. First Attorney wasn’t taking on any new clients. Second one, charged a $200 consultation fee, just to see if he could handle the case. I thought Geez, I should do that, charge people 200 bucks and then tell them, “nope not a good fit for me”. The third one was getting ready to leave town. I finally got to Wills and Wellness.
They where great! The lady scheduled us an appointment for the next day. She said bring in all your legal documents and we will figure out how much time this will take and what it will cost.
The next day my brother and I head down to their offices. We met with a nice lady who read everything over. She politely said the lawyer who put these together didn’t do a good job. However, she indicated everything could be fixed and would only take a couple of hours. The cost was under $1000 and in a matter of weeks the probate courts accepted our documents and we where on our way.
I have to say I was really happy with the work that Wills and Wellness did for us. They explained everything upfront and even gave us an estimated cost, which was lower then what they had quoted.
